Permits

Permits and transfer

In Texas the package store permit belongs to the owner, not the store. Every buyer applies to TABC in their own name.

What that means for a sale

  • The seller keeps trading on their own permit until closing.
  • The buyer applies to TABC for a new permit, and closing is planned around that application.
  • The location must still allow package store sales under local wet or dry rules.
  • TABC reviews everyone with an interest in the business, including spouses, officers and managers.
  • A store that has run in its county for over a year gives the buyer an easier path under section 22.041.

How we help

We work with licensing specialists who prepare and file TABC applications and handle local requirements. We bring them in early, so the permit moves while the rest of the deal is finished. Sellers get a closing date that holds. Buyers open on day one.
