1. Who we are

This website, packagestoretx.com, including its news section (the "Site"), is operated by Package Store TX ("we", "us", "our"). Real estate brokerage services are provided only by Compass RE Texas, LLC (TREC license #9006927), through Jeffrey Grant, licensed Texas real estate sales agent (TREC license #617651), under a separate written agreement. Business sale services are provided by Package Store TX under a separate written agreement.

2. Information only, no offer

Everything on the Site is general information. Nothing on the Site is an offer to buy or sell any business, real estate, permit or other asset, an invitation to make an offer, or a promise to provide any service. Any listing, opportunity or service mentioned on the Site may be withdrawn, changed or sold at any time without notice.

3. Estimates, figures and the calculator

All prices, ranges, multiples, percentages, timelines, statistics and other figures on the Site, including every result produced by the "What's my store worth" calculator and any report it generates (together, "Estimates"), are indicative, non-binding and for general illustration only. Estimates:

are produced automatically from published third-party industry data and the figures you enter, which we do not verify;
are not an appraisal, a valuation opinion, a broker price opinion, a comparative market analysis, a fairness opinion or any other professional opinion of value;
are not an offer, a listing price recommendation or a guarantee of any sale price, sale timeline, buyer interest, financing or outcome;
may be inaccurate, incomplete or out of date, and may differ materially from what any business or property actually sells for.

You must not rely on any Estimate to make a financial, legal, tax, lending, investment, purchase, sale or other decision. Any actual pricing advice is given only after a review of your records under a signed written agreement.

4. No professional advice

Nothing on the Site is legal, tax, accounting, financial, investment, lending, licensing or regulatory advice. Information about the Texas Alcoholic Beverage Commission (TABC), permits, local wet or dry status or the Texas Alcoholic Beverage Code is a general summary only, may be out of date, and must be confirmed with TABC and your own qualified advisers before you act on it.

5. No client relationship

Using the Site, using the calculator, submitting a form, calling us or exchanging emails does not create a broker, agency, advisory, fiduciary or client relationship of any kind. A relationship exists only when you and we sign a written agreement setting out the services and fees. Real estate brokerage services require a written agreement as Texas law provides. 6. Rankings, experience and past results

Rankings, awards, years of experience and descriptions of past work are stated in good faith from third-party sources and our own records. They describe past performance only and do not predict or guarantee any future result.

7. Information you send us

Do not send confidential, financial or personal information through the Site that you are not comfortable sharing before a confidentiality agreement is signed. Information sent through the Site is not treated as confidential until a written confidentiality agreement is in place. You confirm that anything you send is accurate and that you have the right to share it. Our handling of personal information is described in our Privacy Policy.

8. Consent to be contacted

When you submit a form or give us your phone number or email address, you agree that Package Store TX, Jeffrey Grant and Justin Power may contact you about your request by phone call, text message or email at the details you provide. Message and data rates may apply. You can opt out at any time by replying STOP to a text, asking us on a call, or writing to us. Consent is not a condition of any purchase or service.

9. News section and third-party content

The news section shows headlines and short summaries from third-party publishers with links to the original stories. That content belongs to its publishers, is not written, checked or endorsed by us, and may be inaccurate or out of date. Links to other websites are provided for convenience only. We do not control and are not responsible for any third-party website, content, product or service.

10. Acceptable use

You agree not to misuse the Site, including by submitting false information, impersonating anyone, sending spam, interfering with the Site's operation or security, scraping or copying content in bulk, or using the Site for any unlawful purpose. You must be at least 18 years old to submit information through the Site.

11. Intellectual property

The Site's text, design, graphics, calculator logic and branding belong to us or our licensors. Photographs are used under licence from their owners. You may view and print pages for your own personal, non-commercial use. Any other use requires our written permission.

12. Disclaimer of warranties

THE SITE AND ALL CONTENT, ESTIMATES AND TOOLS ON IT ARE PROVIDED "AS IS" AND "AS AVAILABLE", WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING ANY WARRANTY OF ACCURACY, COMPLETENESS, TIMELINESS, MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE OR NON-INFRINGEMENT, AND ANY WARRANTY THAT THE SITE WILL BE UNINTERRUPTED, SECURE OR ERROR-FREE, TO THE FULLEST EXTENT PERMITTED BY LAW.

13. Limitation of liability

TO THE FULLEST EXTENT PERMITTED BY LAW, PACKAGE STORE TX, JEFFREY GRANT, JUSTIN POWER AND THEIR AFFILIATES, PARTNERS, CONTRACTORS AND AGENTS WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY OR PUNITIVE DAMAGES, OR FOR ANY LOSS OF PROFITS, REVENUE, SALE PROCEEDS, BUSINESS, OPPORTUNITY, DATA OR GOODWILL, ARISING FROM OR RELATED TO THE SITE, ANY ESTIMATE, OR YOUR RELIANCE ON ANY CONTENT, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. OUR TOTAL LIABILITY FOR ANY CLAIM ARISING FROM OR RELATED TO THE SITE IS LIMITED TO ONE HUNDRED U.S. DOLLARS (US$100). Some jurisdictions do not allow certain limitations, so some of these may not apply to you. Nothing in these terms limits liability that cannot be limited by law.

14. Indemnity

You agree to defend, indemnify and hold harmless Package Store TX, Jeffrey Grant, Justin Power and their affiliates, partners, contractors and agents from any claim, loss, liability or expense, including reasonable attorneys' fees, arising from your use or misuse of the Site, your reliance on any content or Estimate, information you submit, or your breach of these terms.

15. Governing law and disputes

These terms and any dispute arising from or related to the Site are governed by the laws of the State of Texas, without regard to conflict of law rules. You agree that any such dispute will be brought only in the state or federal courts located in Travis County, Texas, and you consent to their jurisdiction. Any claim must be brought within one (1) year after it arises, to the extent permitted by law. To the extent permitted by law, you waive any right to bring or join a class or representative action about the Site.

16. Changes, severability and entire terms

We may update the Site or these terms at any time. Changes take effect when posted, and your continued use of the Site means you accept them. If any part of these terms is found unenforceable, the rest remains in effect and the unenforceable part is enforced to the fullest extent allowed. Our failure to enforce any part is not a waiver. These terms, together with the Privacy Policy and Disclaimers, are the entire agreement between you and us about the Site. Any signed written agreement for services controls over these terms for those services.
